Free Proxies Terms

1. General Provisions

1.1. These Rules for the Provision of Free Proxies and Rules for Their Use (the "Rules") govern the terms on which OnlineProxy.io provides Users with free trial or promotional access to proxy services, proxy endpoints, test proxies, demo access, and related features ("Free Access").

1.2. These Rules are a special document supplementing:

  • the OnlineProxy.io Terms of Service / Terms and Conditions;

  • the Privacy Policy;

  • the Cookie Policy;

  • and any other applicable legal documents published on the website.

1.3. If there is any conflict between these Rules and the general terms of the website with respect to matters specifically relating to Free Access, these Rules shall prevail. In all other cases, the general terms of the website shall apply.

1.4. Nothing in these Rules limits any mandatory rights of the User as a consumer, where such rights are granted by the applicable law of an EU/EEA Member State.

2. Definitions

For the purposes of these Rules:

2.1. "Operator" means the entity or entities identified as the operator of the OnlineProxy.io platform in the legal documents of the website and/or in the Legal & Trust section.

2.2. "User" means any natural or legal person using Free Access.

2.3. "Consumer" means a natural person acting primarily outside their trade, business, craft, or profession.

2.4. "Proxy" means the technical ability to establish a network connection through a specified proxy endpoint using the issued credentials, address, port, protocol, and other parameters.

2.5. "Supplier" means an independent third party that may actually operate individual proxy endpoints, access to which is arranged through the OnlineProxy.io platform.

3. Nature of Free Access

3.1. Free Access is provided solely for:

  • becoming familiar with the capabilities of the service;

  • compatibility testing;

  • evaluation of technical characteristics;

  • lawful internal testing, research, or integration tasks of the User.

3.2. Free Access:

  • is limited;

  • is provided on a revocable, non-exclusive, and non-transferable basis;

  • does not create any obligation for the Operator to provide paid services;

  • does not guarantee the subsequent provision of paid services on the same terms, with the same IP addresses, characteristics, countries, carriers, speed, availability period, or any other parameters.

3.3. Free Access does not constitute a telecommunications service in the meaning that such term may have under national law, unless expressly stated otherwise by the Operator.

4. Who May Use Free Access

4.1. The User must:

  • be at least 18 years old;

  • have the legal capacity to enter into agreements;

  • if acting on behalf of a company, have sufficient authority to act on behalf of that company.

4.2. The Operator may require account registration, email confirmation, anti-fraud checks, CAPTCHA, phone verification, basic KYC/KYB checks, or other reasonable verification measures where necessary to prevent abuse, comply with the law, or protect infrastructure.

4.3. Unless expressly permitted otherwise by the Operator, Free Access is provided:

  • to one User;

  • for one organization;

  • within one trial limit;

  • without the right to create duplicate, linked, or circumvention accounts for the purpose of obtaining repeated free trials.

5. Scope and Limitations of Free Access

5.1. Free Access may include only part of the functionality of the paid service.

5.2. The Operator may, at its sole discretion, determine and modify:

  • the list of available countries, cities, carriers, and proxy types;

  • protocols and ports;

  • time limits;

  • limits on the number of connections, requests, sessions, or devices;

  • traffic, speed, or frequency-of-use limits;

  • technical parameters relating to stability, rotation, or IP replacement.

5.3. Free Access is provided for testing purposes on an "as is" and "as available" basis, subject to any mandatory rules of law applicable to Consumers.

5.4. The Operator may at any time:

  • replace a proxy endpoint;

  • change an IP address;

  • change a port, protocol, or credentials;

  • temporarily limit or terminate Free Access;

  • introduce additional technical restrictions where necessary for security, legal compliance, or protection of Suppliers, the network, the website, or third parties.

6. Fair Use

6.1. The User must use Free Access fairly, reasonably, and within its intended testing purpose.

6.2. The User is prohibited from:

  • sharing credentials with third parties;

  • reselling, renting out, sublicensing, or otherwise commercializing Free Access;

  • publishing issued credentials, addresses, ports, or instructions that would allow unrestricted use of Free Access by an indefinite number of persons;

  • embedding Free Access into a public or commercial product, service, or API;

  • using Free Access to place disproportionate load on infrastructure.

6.3. The Operator may apply fair use technical measures, including rate limiting, throttling, restrictions on parallel connections, temporary blocking, repeated verification, traffic filtering, anti-bot mechanisms, and other protective measures.

7. Prohibited Uses

7.1. The User may not use, attempt to use, or allow others to use Free Access for any unlawful, harmful, deceptive, or abusive purposes.

7.2. In particular, the following are prohibited:

  • spam;

  • mass sending of messages, comments, emails, submissions, or requests without a proper legal basis and recipient consent where such consent is required;

  • phishing;

  • fraud;

  • distribution of malware;

  • credential stuffing;

  • brute force attacks;

  • unauthorized access to accounts, systems, networks, or data;

  • DDoS attacks;

  • unauthorized scanning of ports, services, vulnerabilities, or network infrastructure;

  • exploitation of vulnerabilities without proper authorization;

  • operation of botnets;

  • circumvention of sanctions, export controls, geographic restrictions, anti-fraud restrictions, or other legal restrictions;

  • creation, operation, or scaling of fake accounts, ad fraud, click fraud, fake engagement, or other forms of abusive automation;

  • unlawful scraping, harvesting, or extraction of data in violation of law, third-party rights, or binding terms of the relevant website;

  • infringement of intellectual property rights;

  • harassment, stalking, threats, discrimination, or dissemination of unlawful content;

  • processing of personal data in violation of the GDPR, ePrivacy rules, the national laws of EU/EEA Member States, or any other applicable rules.

7.3. The User may also not use Free Access to circumvent:

  • limits;

  • free trial restrictions;

  • blocks;

  • suspension decisions;

  • access control mechanisms;

  • geo-blocking;

  • security and anti-abuse mechanisms of third parties.

8. User Obligations

8.1. The User must:

  • comply with applicable law;

  • respect the rights of third parties;

  • comply with the terms of use of websites, platforms, and services with which the User interacts through the Proxy;

  • keep their credentials secure;

  • promptly notify the Operator of any suspected compromise of access, unauthorized use, data leak, or abuse.

8.2. The User is solely responsible for:

  • selecting the purposes for which Free Access is used;

  • the lawfulness of their activities;

  • obtaining any necessary consents, permissions, and legal bases for data processing;

  • ensuring that their activities comply with rules relating to direct marketing, advertising, data protection, intellectual property, competition, and consumer protection.

9. Security, Technical Data, and Privacy

9.1. The Operator is not obliged to conduct general monitoring of the content of the User's traffic and does not undertake to actively monitor every action of the User through the Proxy, unless required by law.

9.2. However, the Operator and/or Suppliers may process limited technical and service-related data necessary for:

  • providing Free Access;

  • authentication;

  • prevention of fraud and abuse;

  • diagnostics of technical errors;

  • ensuring the security of the network and infrastructure;

  • compliance with applicable law;

  • handling complaints and requests from competent authorities.

9.3. Such data may include, in particular:

  • date and time of connection;

  • number of connection attempts;

  • the IP address of the platform account;

  • port number and protocol type;

  • error codes;

  • abuse/fraud signals;

  • approximate usage indicators necessary for fair use enforcement and diagnostics.

9.4. Personal data shall be processed in accordance with the Privacy Policy and applicable data protection law.

9.5. If the User's personal data is transferred outside the EU/EEA, the Operator shall ensure that an appropriate legal transfer mechanism is in place in accordance with applicable law.

10. Suspension, Restriction, and Termination of Free Access

10.1. The Operator may immediately restrict, suspend, or terminate Free Access in whole or in part if:

  • the User has violated these Rules, the general terms of the website, or the law;

  • the Operator has reasonable grounds to suspect abuse, fraud, spam, security abuse, sanctions risk, or other violations;

  • this is required by a Supplier, competent authority, court, or other lawful demand;

  • this is necessary for maintenance, security, updates, or protection of infrastructure;

  • the Free Access has ended as a promotional or trial program.

10.2. Where required by applicable law, the Operator shall provide the User with information about the reasons for the restriction or termination and about any available channel to contact the Operator or contest the decision.

10.3. In the event of serious or repeated violations, the Operator may:

  • delete or block the account;

  • refuse a repeated free trial;

  • prohibit the creation of new accounts;

  • use technical means to prevent repeated abuse.

11. No Fee and Consequences of Termination

11.1. Free Access is provided without separate charge unless expressly stated otherwise by the Operator.

11.2. Termination of Free Access does not in itself create any right for the User to claim monetary compensation, unless otherwise provided by mandatory law.

11.3. If Free Access was provided together with other services, the User's rights in relation to those other services shall be governed by the separately applicable documents.

12. Intellectual Property

12.1. All rights in and to the website, platform, software interface, documentation, texts, branding, trademarks, design, knowledge base, API documentation, and related materials belong to the Operator or its licensors.

12.2. These Rules do not transfer any rights to the User other than the limited right to use Free Access within the scope expressly set out in these Rules.

13. Complaints, Requests, and Notices of Violations

13.1. The User may submit questions, complaints, legal notices, abuse notices, and reports of unlawful use of Free Access through the contact details published on the website.

13.2. The Operator may request from the User reasonable information supporting the request, including:

  • account identifier;

  • dates and times of the incident;

  • description of the problem;

  • technical logs excluding traffic content;

  • any other materials necessary for verification.

13.3. The Operator shall review requests within a reasonable time, taking into account the nature of the request, technical complexity, and mandatory requirements of applicable law.

14. Rights of Consumers in the EU/EEA

14.1. Nothing in these Rules limits the mandatory rights of a Consumer under the applicable law of the Consumer's country of habitual residence.

14.2. Where applicable law on digital content or digital services grants the Consumer rights to remedies such as bringing the service into conformity, price reduction, termination, refund, or other legal remedies, such rights remain preserved to the extent required by mandatory law.

14.3. Any provision of these Rules shall be interpreted in favor of preserving the mandatory rights of the Consumer.

15. Warranties and Liability

15.1. For Users who are not Consumers, Free Access is provided "as is" and "as available," without SLA and without warranties of continuous availability, compatibility, uninterrupted operation, geolocation accuracy, fitness for a particular purpose, or absence of blocking by third parties.

15.2. For Consumers, this clause applies only to the extent permitted by mandatory law.

15.3. Nothing in these Rules excludes or limits liability that cannot be excluded or limited under mandatory law, including liability for intent, gross negligence, fraud, and any other case where such limitation is prohibited by law.

15.4. For Users who are not Consumers, the total aggregate liability of the Operator arising out of or in connection with Free Access shall be limited to EUR 100 (one hundred euros), unless a higher limit is required by mandatory law.

16. Governing Law and Dispute Resolution

16.1. If the User is a Consumer and habitually resides in an EU/EEA Member State, the User retains the protection of the mandatory provisions of the law of their country of habitual residence.

16.2. For Users who are not Consumers, and to the extent not contrary to mandatory law, these Rules shall be governed by the laws of the Netherlands, excluding its conflict of laws rules.

16.3. Any dispute with a User who is not a Consumer shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

16.4. A Consumer may bring proceedings before a court or other body having jurisdiction under the mandatory rules applicable in the Consumer's country of habitual residence, where such right is granted by law.

16.5. Nothing in these Rules limits any mandatory right of a Consumer to out-of-court dispute resolution or to contact a supervisory authority, consumer protection authority, data protection authority, or Digital Services Coordinator.

17. Amendments to the Rules

17.1. The Operator may amend these Rules by publishing an updated version on the website.

17.2. Material changes shall take effect on the date stated in the updated version of the Rules.

17.3. Where required by applicable law, the Operator shall provide reasonable prior notice of material changes.

17.4. Changes required by law, security needs, infrastructure protection, abuse prevention, or mitigation of technical risks may take effect immediately.

18. Contact Details

18.1. Contact details for matters relating to Free Access, abuse, privacy, and legal notices shall be published on the OnlineProxy.io website in their current version.

18.2. For users in the EU/EEA, the following shall also be indicated where required by applicable law:

  • the contact point for requests under the Digital Services Act;

  • details of the EU representative;

  • contacts for privacy/GDPR requests.
